Terms of Service

1. Agreement

By creating an account or using Listing Lens ("the Service"), you agree to these Terms. The Service is operated by UPD8 Group Pty Ltd, an Australian company.

2. What Listing Lens Does

Listing Lens is an AI-powered buyer intelligence tool. You provide a product listing (via URL, screenshot, pasted text, or photo) and we generate an analysis report using artificial intelligence.

Important: Listing Lens reports are AI-generated buyer intelligence — not professional valuations, appraisals, inspections, or legal advice. Always conduct your own due diligence and seek professional advice where appropriate.

3. Accounts

You must create an account to use the Service. You can sign up via Apple, Google, or email through Clerk. You must be at least 18 years old.

4. Pricing and Payment

Starter: $1.00 AUD for 2 reports. Account creation is free.
Pay-as-you-go: $4.99 per report, or credit packs of 5 ($19.99) or 10 ($34.99).
Subscriptions: Pro ($9/month or $79/year) and Pro+ ($19/month or $159/year).
Refunds: Reports are non-refundable once generated. Failed generations are refunded or credited.
Credits: Pay-as-you-go packs never expire. Subscription allowances do not roll over.

5. Subscriptions

Subscriptions renew automatically. Cancel anytime — monthly cancels at end of period, annual runs to end of year. No partial refunds.

6. Acceptable Use

You may use reports for personal purchasing decisions, share with advisors, and print for records. You may not resell reports (unless Pro+ white-label), use the Service for scraping or data harvesting, submit illegal content, or create multiple accounts to bypass limits.

7. Accuracy

Reports are AI-generated using publicly available information. We do not guarantee accuracy, completeness, or reliability. Market conditions change. Report quality depends on your input quality. We are not licensed valuers, agents, or financial advisors.

Limitation of Liability: To the maximum extent permitted by Australian law, UPD8 Group Pty Ltd is not liable for any loss or damage arising from reliance on a Listing Lens report, including financial loss from purchasing decisions.

8. Intellectual Property

The Listing Lens name, logo, report format, and website design are owned by UPD8 Group Pty Ltd. Reports are licensed for your personal use.

9. Privacy

See our Privacy Policy for details on data collection and your rights.

10. Termination

You can delete your account anytime by contacting us. We may suspend accounts that violate these terms.

11. Changes

We may update these terms. Significant changes will be notified. Continued use constitutes acceptance.

12. Governing Law

These terms are governed by the laws of the Australian Capital Territory, Australia. Nothing excludes consumer guarantees under the Australian Consumer Law.
